PART 1: RESERVATION TERMS AND CONDITIONS

INTRODUCTION AND GENERAL PROVISIONS

Your reservation and the accommodation agreement made with Governor’s Home (“”GH””) and it’s owners, Frontiera LLC, (whether made by you directly or via a third party such as a travel agent) will be subject to these Reservation Terms and Conditions and the Reservation Privacy Policy set out below.

When you make your reservation, you will be deemed to have read, understood and accepted these Reservation Terms and Conditions and the Reservation Privacy Policy.

If you make your reservation via a travel agent, or other third party, then you have a separate legal relationship with that party and  (“GH”) has no liability for any acts or omissions of such party including their observance of your data protection rights.

When you make your reservation, you will be also deemed to have read, understood and accepted the terms and conditions for using the GH website (which shall mean www.governorshome.com or any related GH web pages accessible from it) and any relevant terms and conditions shall be deemed to be incorporated into your reservation and the accommodation agreement with the GH. GH provides an online reservations facility on the GH website (together called “the Reservations Facility”) as a service. All information and photos regarding rooms, facilities, products and services offered at GH, contained on the GH website or otherwise available through the Reservations Facility, were deemed accurate at the time the website and reservation facility were created and launched. SLH does not make any representation or warranty, express or implied, of any kind with respect thereto. Such information may be inaccurate as a result of renovation or repair, damages made by recent guests,etc. The SLH website may also contain typographical errors or omissions. When notified of such errors, GH will make a good faith effort to address and correct any omissions or inaccuracies.

As  such GH shall not be liable to you for:

(i) inaccuracy or completeness of any information provided to or through the Reservations Facility including, without limitation, the availability or price of rooms, facilities, products or services, or for any other errors or omissions of GH; or

(ii) any failure or delay beyond its control in the transmission of any data submitted to or through the Reservations Facility including, but not limited to, the details of your reservation or changes to or cancellation of your reservation, in each case to the fullest extent permitted under applicable laws.

RESERVATIONS PROCEDURE AND POLICIES

1. Online reservations

The GH website and reservation facility enables you to check the accommodation offerings and availability of GH (and related products and services). On completion of the reservation process, the Reservations Facility will transmit an online or email confirmation of your reservation. A reservation is only valid when a reservation number has been issued and you or the guest has paid. Relevant details relating to additional products and/or services which you may request must be confirmed by you directly GH in writing.

2. Accomodation Prices

The prices indicated on the GH website  for the GH rooms and villa, products and services are subject to availability. Breakfast is only included if the option and selected and paid for as an additional service. Taxes and service charges are applicable and indicated at the time of booking reservations.

3. Payment

It will be necessary for you to provide credit card details to secure a room, product or service reservation. The credit card may then be used by GH for payment or a deposit as advised at the time of booking or as a guarantee for a future payment, in the case of a no-show, a cancellation or change to the reservation.

4. Cancellations and Amendments

You should make any cancellations or amendments to your reservation using the same channel through which you booked. The cancellations and amendments policy that applies to your reservation will depend on the respective OTA ( online travel agency) or GH policy ( see GH Cancellation Policy)  as indicated at the time of booking.

5. Rate/Reservation Validity

Reservation confirmations are provided to you solely for your convenience. GH retains official records of direct reservation transactions, including details of dates of stay and room, product and service rates. In the event of discrepancies, alterations, modifications, or variations between this confirmation and our official records, GH’s official records shall prevail. Tampering with this confirmation to alter any room, product or service rate or any other reservation information is strictly prohibited and will have legal consequences.  If you have made a reservation via another party other than GH for GH, GH may not have access to the complete record of charges, fees and conditions related to such bookings, and can not be held liable for any refunds that may be due via such channels.

6. Early Departure

GH does not provide refunds for early departures and also may require a minimum stay. You may change your check out date in advance of your stay without a penalty only if your rate and your GH reservation conditions permit.

7. Currency

Reservations will be charged in US Dollars.  A foreign currency transaction may be charged by your card provider. Any deposits or pre-payments will be deducted from the final reservation invoice in US Dollars.

A refund of a deposit or prepayment, if any, will be subject to the exchange rate applied by your payment card provider at the time of any such refund and may differ from the exchange rate applied at the time such deposit or prepayment was made.

8. Rate Requirements

As some rates have special requirements at check-in, such as number of guests and room occupancy limits, you should verify that your booked rooms meet such requirements for your reservation.  GH is not obligated to provide addition rooms facilities for reservations that exceed occupancy requirements for the rooms that have been booked.

9. Payment, Reservations and Refunds

Full payment is taken at time of reservation booking. Once you make a reservation your credit card will be charged for the full amount. Credit will not be given for any  ‘no-shows’ or unused reservation and the amount paid by you for such reservation cannot be used toward any other/future reservation.

Should your travel plans change, we will refund the entire amount less one night’s charge if cancelled up to 14 days prior to reservation arrival date. The one night charge will be based on standard book rates for the room, room combination or villa plus any applicable taxes.  Cancellations within less than 14 days will not be refunded

10. Reservation Holding Period and Cancellations by GH

For all reservations paid with a credit card at the time of making your reservation,  reservations are held until check-out time on the day following the day of arrival unless communicated in writing otherwise. Rooms, products or services booked with an invalid credit card are subject to immediate cancellation.

11. Overbooking

In the event that a guest cannot be accommodated due to a reservation facility overbooking or an unforeseen circumstance, GH will attempt to notify guests in a timely manner with the contact details provided by the guest and issue a full refund of any credit card charges that may have been collected for the overbooked reservation.

12.  Respect for Property, Neighbors and Community  – Large Gatherings / Parties

You agree in making this booking that you recognize GH is registered on the National Register of Historic Places, that your contract is limited to accomodation for the number of guests and rooms booked.  You recognize large gatherings or parties in excess of the capacity of booked rooms are forbidden without the express written consent of GH.  You agree not to engage in large gatherings or parties, and if hosting temporary visitors to respect the maximum capacity restrictions of the property as may be communicated by this website or management for GH.  Any violation of this clause, or excessive noise which generates complaints from the neighborhood or community, may result in immediate termination of your reservation without refund and requirement to leave the property.

13. Special Requests

GH will strive to honour any reasonable requests to ensure your stay is comfortable and make such arrangements if possible prior to your stay. Until specific confirmation is issued then your request cannot be guaranteed and neither can GH guarantee that your request will be honoured.

14. Cleaning

GH contracts with professional 3d party service providers to ensure that the GH facility and property are thoroughly cleaned and maintained. The Villa and Room are cleaned and serviced with fresh linens between each stay with enhanced cleaning protocols. GH continuously monitors its providers  but can make no warranties related to their performance. Daily or more frequent cleaning can be requested at additional cost.

15. Pets

We love dogs but unfortunately given the status of Governor’s Home as a Historic Registered residence, and the owner’s family and frequent guest health (allergies) issues related to pets,  we can not host animals in the home or grounds. As such, all animals are forbidden on and in the GH property and facilities.  Any evidence of non-compliance will result in forfeiture of reservations, payments, and if deemed necessary additional charges for any damages.

16Smoking and Recreational Drug Usage

Smoking in any form as well as the use of recreational drugs, whether legal or illegal, are not permitted. Any evidence of non-compliance will result in forfeiture of reservations, payments, and if deemed necessary additional charges for any damages.

17.  Damages & Theft

Any damages to the property deemed to be beyond normal wear and tear or theft of items belonging to the property shall be subject to charges deemed applicable by GH and its owners.  GH will make a good faith effort to communicate with you or the guest who made the reservation to inform of the damages or theft discovered and related charges.  Excessive damage and or theft may be reported to authorities and/or legally pursued.

18. Security and Surveillance

GH maintains a property safety and security system which includes fire alarms, temperature and leak sensors, and video cameras in exterior and interior common hall areas. There are no cameras in private areas ( bedrooms, bathrooms, etc.) and the system is monitored by a professional security firm.  GH takes guest privacy and guest safety seriously.  Video cameras on the exterior remain on to ensure property and guest security at all times recording movement in and out of the property. Interior cameras operate only when the villa is not occupied but may be activated if an alarm ( ie., smoke, fire, etc.) is triggered.  Footage from cameras is recorded and automatically deleted within 2 weeks of guest departure unless needed for review for legal purposes, enforcement of this agreement or law, or requested by authorities. Any tampering or attempts to disable security and safety devices on the property shall result in eviction.

19. Guest’s Obligations

You agree to the terms and conditions of purchase underwritten herein for your reservation and stay at GH. You also agree that you are fully responsible and shall pay for all charges, fees, duties, taxes, assessments and other amounts arising out of your reservation when due, including additional taxes and fees that may not be included in the quoted rate.

You  agree and understand that you must be at least 25 years of age, or older, to utilize the GH Website, or to take an interest in, or make a booking for the Services offered. By accessing or utilizing the Website, or by reserving a room or rooms, you warrant that you are no less than 25 years of age.

You understand that any violation of an GH’s conditions may result in cancellation of your reservation and you forfeiting any monies paid for such reservation and GH debiting  or charging your account for any costs it incurs as a result of such violation.

20. Privacy and data protection

Our Reservation Privacy Policy (set out below) will apply to your reservation and forms part of these Reservation Terms and Conditions.

21. Intellectual Property Rights

GH and Frontiera llc have copyright and trademark protections. Any copyright and other intellectual property in the content and materials on the GH website remains with GH. Downloading, copying or otherwise using any material on the GH website is not permitted without express written consent of GH or parties which it may have usage agreements.

22. Force Majeure

Neither GH nor its owners or managers will be liable for any change or cancellation of any reservation that is caused, in whole or in part, by events, occurrences, or causes beyond the control of GH or any affiliate. Such events, occurrences, or causes include, without limitation, acts of God, terrorist activities, weather, strikes, lockouts, riots, acts of war, earthquake, illnesses, highway closures, volcanic activity, ash clouds, tsunamis, fire and explosions.

23. Limitations

Neither GH nor nor other providers of products or services related to the Reservations Facility are responsible for communication malfunctions, failures, difficulties or lost, stolen, or misdirected transmissions, messages or entries, or the security of any such communications to the fullest extent permitted under applicable laws. Further, neither GH nor any other providers of products or services related to the Reservations Facility are responsible for incorrect or inaccurate entry information, whether caused by user(s), by any of the equipment or programming associated with the Reservations Facility, or by any technical or human error that may occur in the processing of any information related to the Reservations Facility and shall not be liable for damages resulting from any of the foregoing to the fullest extent permitted under applicable laws .

GH may cancel or modify reservations where it appears that a user has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error.

24. Governing Law

These Reservation Terms and Conditions are governed by the laws of Wyoming and the courts of Wyoming shall have exclusive jurisdiction in relation to any dispute in relation thereto.

25.  Survivability and Continuance

If any clause(s) in this agreement is deemed by a Court of Law to be illegal or non – enforceable, the remaining clauses shall be recognized as valid, enforceable.

PART 2: RESERVATION PRIVACY POLICY

This Reservation Privacy Policy provides you with information about the personal data GH collects in connection with your reservation, why we need to collect it, how it will be used, who it will be shared with and your rights in relation to it.

The personal data GH collects

In order to complete your reservation and arrange its fulfilment GH needs to collect the following personal data as part of the reservation process:

  • your first and last name;
  • your email address;
  • your address and country of residence
  • your date of birth
  • your mobile telephone number
  • details of your payment card including the card number, cardholder name, expiry date and CVV number.

You may also, if you wish, provide GH with:

  • additional guest and contact information

The personal data you provide GH in the course of the reservation process will be referred to in this Reservation Privacy Policy as the Reservation Data.

How GH uses the Reservation Data

GH will contracted third parties be the data controller of the Reservation Data.

It is necessary for GH to collect the Reservation Data so that the contract for your reservation can be fulfilled, and to take all necessary steps that involves including transmitting the Reservation Data to the relevant payment processors and recording for insurance purposes.

GH has appointed a third parties within the United States to process the Reservation Data and payments.

In relation to any transfers of the Reservation Data outside the European Economic Area necessary to complete and fulfil the reservation, GH has contracted with these third parties to fulfil all necessary legal, technical and organisational measures to ensure the protection of the Reservation Data as may be needed to complete payment and process your reservation.

GH will only share the Reservation Data with its appointed processors and insurance provider to the extent necessary for booking of your reservation. GH will not use the Reservation Data for any purpose other than for these outlined purposes and fulfilling your reservation.  Unless obligated by law, GH will not share your data with any additional third parties and will not sell it for marketing purposes.  GH may however use the data after your reservation date to communicate with you  and /or provide you offers related to or for future reservations you may make. You may opt out of such communications.

If any part this privacy policy is deemed unlawful or unenforceable, the remaining language and provisions shall remain intact.
